1. Purchase and Installation of a Grid-connect PV Solar System

1.1 On payment of a deposit, you have contracted to purchase your selected Grid-connect PV solar system subject to these terms and conditions.

1.2 You have discussed your design requirements and installation with a representative of Climatecare Electrical. Click here for onsite visit information

1.3 Climatecare Electrical will purchase on your behalf the Grid-connect PV Solar system components which meet all relevant Australian standards and suitable to meet the technical requirements, as detailed on your order.

1.4 Climatecare Electrical is a Clean Energy Council, accredited PV Solar Designers/Installers and is a licensed Electrical Contractor. Your installation shall meet the relevant Australian standards, and suitable to meet the technical requirements of the RET Scheme.

2. Payment

2.1 Payment of the deposit is required, as cleared funds in the bank account as specified by Climatecare Electrical, and shall be paid upon receipt of the tax invoice. The amount of the deposit shall be the amount specified on the price guide applicable to system size ordered.

2.2 You are entitled to withdraw from this contract if an agreement for an Inverter Energy System (IES) Network Agreement http://www.ergon.com.au/your-home/using-renewable-energy/solar-power is not approved by Ergon. Climatecare Electrical will refund your deposit less a $100.00 cancellation fee.

2.3 Once the IES Network Agreement has been approved, the full deposit payment becomes non-refundable. At that time, Climatecare Electrical will schedule your installation.

2.4 You agree to pay Climatecare Electrical the balance payment on the day of installation as cleared funds in the bank account as specified by Climatecare Electrical.

2.5 Legal title for any goods and components supplied herein for the Grid-connect PV Solar system will remain the property of Climatecare Electrical until such time that they are paid in full.

2.6 Renewable Energy Certificates REC’s http://www.orer.gov.au detailed in the price guide are not offered as a point of sale discount. Climatecare Electrical shall provide all documentation so as you receive the value of these certificates directly payable to your nominated bank account.

Climatecare Electrical, will offer a point of sale discount for REC”s as a part payment. By pre-assigning your REC’s at point of sale, thus fixing the price of your system, you are liable for the value of the REC’s as detailed on your invoice should you not proceed with the supply and installation with Climatecare Electrical.

2.7 All amounts payable are subject and include GST.

3. Authority of access to property

3.1 You warrant you are the property owner at the address stated in your application.

3.2 You authorise Climatecare Electrical (its contractors, employees and installers) to have access to the property at times it reasonably requires. This access may include, but is not limited to, site inspections, the signing of required paperwork, the delivery and installation of the Grid-connect PV Solar system, and connection to the grid network.

3.3 You will co-operate as fully as possible to enable the safe installation at the earliest possible time convenient to Climatecare Electrical.

4. Termination

4.1 Climatecare Electrical may terminate this agreement with you if:

4.1.1 you do not abide by the terms and conditions.

4.1.2 there are delays in the process causing supplier pricing to increase. A refund under clauses 2.2 will apply.

4.1.3 If the Grid-connect PV Solar System price is adversely affected by world financial markets, and the value of the Australian dollar at the time of ordering the equipment (after IES is granted) for your Grid-connect PV Solar System. Should this occur, Climatecare Electrical will advise and a new price will be offered.

Up to now, we have been able to provide stable pricing to our customers and have even been able to provide lower pricing when the exchange rate has risen however you need to be prepared as the value of the Australian dollar and the REC’s price may affect the final price.

4.2. You may terminate this agreement before installation if delays have caused a price rise and you do not wish to absorb those increases. A refund under clause 2.2 will apply.

5. Liabilities and Risk

5.1 The ownership and insurance risk of the PV solar system passes to the home owner upon completion of installation. Climatecare Electrical suggests you check with your insurance company as to their requirements to ensure adequate coverage of your PV solar system on your policy.

5.2 Arrays that require a tilt mount affect the wind rating of the homes structure, No Engineer Certification or Guarantee provided. If you are concerned, Climatecare Electrical advises you to seek independent structural certification of the fixing of a tilt kit to the existing roofing structure. Climatecare Electrical accepts no responsibility for roof damage caused by storms where a tilt kit is used.

5.3 Climatecare Electrical accepts responsibility for any damage or loss caused by the installer at time of the installation. Climatecare Electrical will work with you to rectify any damage to your property caused by the installer, provided that you notify Climatecare Electrical within 30 days of installation subject to clause 5.4.

5.4 Grid-connect PV Solar Systems are roof mounted, and require installation workers to walk (traffic) upon the roof, whilst all care is taken, at times dents or creases may be unavoidable due to the nature of work and could be noticeable. Unless they cause water to ingress, these areas will not be replaced.

6. Product Warranties

6.1 The warranty period for material defects and workmanship is from the date of delivery/installation. The warranty period with respect to power output continues for a total of 25 years from date of delivery - the first 10 years at 90% and the following 15 years at 80% of the power output as specified in Product Specification.

The inverters have a varying warranty (5 years standard or 10 years extended) depending on the model, and as detailed on your order and show on tax Invoice.

The mounting frames have a warranty of 10 years.

6.2 The installation workmanship warranty is 12 months from the date of installation. After 1 year you are responsible for any costs in removing and returning any components under their respective manufacture warranties.

6.3 Climatecare Electrical does not guarantee any particular level of performance of the PV Solar system. The performance is subject to a number of local factors including the roof orientation and pitch, the number of hours of direct sunlight, cloud cover and shading from building structures and trees.

Before an order for Climatecare Electrical Grid-connect PV Solar system is accepted, the PV Solar array orientation and tilt have been discussed. The system purchaser has agreed to the array site area, large enough to accommodate the array.

The performance of the PV Solar array will be determined based on orientation and tilt, using the CEC GC Design and install guidelines as a reference.

7. Privacy Policy

7.1 You agree to provide Climatecare Electrical with whatever personal information is required for the efficient functioning of the installation process on your behalf, in particular for the accurate completion of the paperwork, IES network connection to the grid, and the assignment of your REC’s.

7.2 Climatecare Electrical will provide your information to its contractors, employees and installers only so far as to effectively perform their role.

7.3 Climatecare Electrical will provide your information on your behalf to the relevant bodies for the processing of the REC’s assignments and connecting your PV Solar system to the Grid network, and if asked, your electricity retailer.

7.4 You may access the personal information we have collected from you with a request in writing.

7.5 Unless otherwise agreed with you, Climatecare Electrical will not provide your personal information to any third parties other than those mentioned above.
